The Health Law Practice Group at Whiteman Osterman & Hanna, LLP provides services to a wide range of clients including physician practice groups, hospitals, dental groups, individual practitioners, home health agencies, community based organizations, long term care facilities, ambulatory surgery centers, behavioral health providers and telemedicine providers.

Taking a multidisciplinary approach, the health law practice group draws from the scope and depth of expertise within the Firm to assist health law clients with all aspects of their business including corporate governance, corporate transactions (simple and complex), employment practices, medical staff issues, licensing, regulatory compliance, reimbursement, real estate, capital financing, tax issues, immigration, internal and government investigations, privacy and security matters, and day to day operational and patient care challenges.

During the past several decades, Whiteman Osterman & Hanna has developed an unsurpassed familiarity and understanding of the process related to the regulation of health are providers and health care service delivery in New York State and has maintained ongoing contact with the individuals responsible for making and implementing the laws governing and regulating the health care delivery system across the state.

Health Care Reform

We provide advice and counsel to clients as they navigate the and respond to the dynamic health care regulatory environment and evolving reimbursement models. Specifically, we assist clients participating in the New York delivery system reform incentive payment program (“DSRIP”), Accountable Care Organizations (“ACO”), shared savings agreements, and other alternative payment models designed to drive improved quality, reduced costs, increased access and patient satisfaction.

Corporate Governance

We assist clients and their respective governing bodies to understand and discharge their fiduciary duties and regulatory oversight obligations. We often provide education and guidance relating to matters of strategic planning, corporate integrity, operational transparency, conflicts of interest, and corporate compliance.

Regulatory Compliance, Investigations, Audit and Response to Government Agencies

The Attorneys at Whiteman Osterman & Hanna have years of experience investigating and evaluating alleged misconduct including, but not limited to, fraud, abuse and waste. We represent clients in Medicare, Medicaid investigations, and proceedings before the New York State Department of Health, Office of the Attorney General, Office of Medicaid Inspector General, Office of Inspector General, Centers for Medicare and Medicaid Services, and Department of Justice. Further, we have unique in-house experience necessary to help clients develop and implement, and evaluate the effectiveness of their compliance programs, lead internal investigations/audits to proactively identify opportunities for improvement to avoid government scrutiny or in response to government agencies to prevent recurrence. We regularly advise clients on matters implicating federal and state Stark and Anti-kickback issues.

HIPAA Privacy and Security

Our attorneys have training, education and experience, including CIPP/US certification meeting ANSI/ISO standards, demonstrating proficiency in HIPAA privacy and security, data protection and information management principles. We assist clients with policy development, gap analysis, education and auditing, third party vendor management, data breach identification mitigation and response, international data transfer laws and regulations, Red Flag Rules, among other matters.

Health Care Reimbursement

We assist our health care clients to navigate the complex health care reimbursement system including, but not limited to, Medicaid and Medicare billing and reimbursement issues, and guide them through the voluntary self-disclosure processes to manage overpayments when necessary.

Health Care Transactions, Operations and Contracts

The health care attorneys in collaboration with attorneys from our Corporate, Tax, and Real Estate Practice Groups offer our clients in depth expertise in structuring, analyzing and negotiating mergers, acquisitions, joint ventures, captive arrangements, managed care agreements, certificate of need and other regulatory licensing/certification matters.
