Erin Callahan quoted in Business Review Article “What NY employers need to know about new guidance on cannabis in the workplace”

Labor and Employment Partner, Erin Callahan, was quoted in the recent Business Review article “What NY employers need to know about new guidance on cannabis in the workplace.”  With the recent legalization of cannabis, it has been unclear as to what actions employers can take when employees are under the influence.   The Department of Labor provided clarification on the rights of employees and what steps employers should take if they believe an employee is under the influence.  Erin said the guidance did provide more clarification with respect to evidence of “specific articulable symptoms” and advised that the most important thing for employers to do is to be observant and pay attention to detail to determine if an employee is under the influence. To do so, employers are going to have to rely on supervisors who are well-trained on what to do when they suspect an employee is under the influence and what is needed under the law to take disciplinary action.
