WOH Attorneys Prevail in Challenge to Amazon Distribution Facility

Whiteman Osterman & Hanna recently prevailed in the defense of a challenge brought to halt the construction of an approximately one million square foot Amazon distribution facility located in Schodack, New York being constructed by Scannell Properties.  

After prevailing in the lower court, the firm’s attorneys successfully defended an appeal which sought to set aside the approvals and environmental review process for the facility.  The New York Supreme Court, Appellate Division agreed with the firm’s arguments and upheld the dismissal of the proceeding, finding that the environmental review process conducted for the project was consistent with New York’s State Environmental Quality Review Act (“SEQRA”).  

Scannell was represented in the litigation by John J. Henry and Tara MacNeill from the firm’s litigation group and in the approval process by Terresa M. Bakner, J. Stephen Reilly, and Charles Gottlieb.
