David R. Everett
Partner

David R. Everett is a partner in the Firm’s CleanTech, Environmental, Municipal and Real Estate Development, Zoning and Land Use Practice Groups. He joined Whiteman Osterman & Hanna in 1993. His areas of expertise include land use law, zoning and planning, real estate development, SEQRA compliance, solid waste management and environmental regulations. Mr. Everett routinely lectures on SEQRA compliance, zoning and planning issues and environmental permitting regulations throughout New York State for the N.Y. Association of Towns and N.Y. Planning Federation, among others.

Representative Accomplishments

Whiteman Osterman & Hanna

  • Assisted one of the largest home builders in the Country with environmental and land use issues associated with the construction of over 2,500 homes in the greater New York City area including single-family homes, town homes, condominiums, age-restricted communities and affordable housing. Conducted due diligence investigations to identify environmental and land use permits required for large residential communities. Assisted with the redevelopment of large urban brownfield sites for residential communities.
  • Assisted New York State Thruway Authority with environmental impact assessment and permitting issues associated with the redevelopment of the Tappan Zee Bridge and I-287 corridor from Port Chester, NY to Suffern, NY.
  • Assisted developers of regional shopping centers and supermarkets in complying with federal, State and local environmental and land use laws. Prepared environmental impact statements and other SEQRA documents for large development projects. Addressed traffic issues associated with the impacts of large scale development on State highways. Assisted developers with State and federal takings issues.
  • Assisted clients in obtaining land use approvals from planning and zoning boards including site plan and subdivision approvals, special use permits, variances, zoning amendments, etc. Handled all aspects of land use litigation.
  • Assisted developers in obtaining environmental permits and approvals from federal, State and local agencies including wetland permits, SPDES permits, stream impact permits, flood protection permits, air permits, drainage permits, etc.
  • Assisted in obtaining land use approvals for the Woodstock Music Festivals in 1994 and 1999. Prepared SEQRA documents for the festival and prepared and negotiated numerous contracts on environmental issues, including contracts for the removal of septage, solid waste, hazardous waste and regulated medical waste.
  • Assisted FORTUNE 500 and other companies in compliance with State and federal environmental laws including air, water and underground storage tank regulations.
  • Represented clients before State and federal agencies in enforcement actions regarding alleged violations of environmental laws. Negotiated consent orders with the EPA and New York State Department of Environmental Conservation.
  • Handled all aspects of complex Superfund litigation in connection with remediating the Syosset Landfill in New York. Handled oil spill litigation under the Navigation Law in New York.

Coombs Kranis & Wing

  • Assisted developers in obtaining land use and environmental approvals for commercial projects in Dutchess County. Represented developers before local zoning and planning boards. Handled all aspects of land use litigation.
  • Assisted the Dutchess County and Ulster County Resource Recovery Agencies in siting County-wide landfills, developing solid waste management plans, and enforcing flow control and recycling regulations. Handled litigation challenging the constitutionality of Ulster County's flow control law. Assisted public authorities in obtaining bond financing for environmental projects.
  • Represented the City of Poughkeepsie wastewater treatment plant on various industrial pretreatment matters including compliance and enforcement. Redrafted the City's industrial pretreatment regulations.

Affiliations
Mr. Everett is a member of the New York State Bar Association, Environmental Law Section; the American Bar Association, Natural Resources, Energy and Environmental Law Section; the Wetland’s Forum; and the Environmental Law Institute. He is the Chairman of the Town of Chatham Zoning Board of Appeals, a member of the Columbia County Environmental Management Council and a board member of the New York Planning Federation. He is also a former member of the Board of Directors of the Environmental Law Foundation and a former board member of the Historic Albany Foundation. Mr. Everett is admitted to practice law in New York, New Jersey, and the District of Columbia. He is the co-author of the “Administrative Decisions Update” published quarterly in the New York State Bar Association’s Environmental Lawyer Journal. He is also a co-editor of “Inside Albany,” a monthly column published in Environmental Law in New York by Matthew Bender & Co.

Background
Mr. Everett received a Juris Doctor and Certification in Environmental Law from Pace University School of Law. He was awarded a Bachelor of Arts in Political Science from Gettysburg College.
