Thomas W. Simcoe advises clients on all aspects of tax planning and compliance in both the commercial and not-for-profit sectors.

Background

Mr. Simcoe’s representative tax-exempt organization engagements include providing counsel for the formation of new entities, structuring organizations with multiple entities and for-profit subsidiaries, and advising on mergers and dissolutions. He also advises exempt organization clients on compliance matters such as the treatment of unrelated business income and private foundation/public charity status. Organizations represented include charities, educational institutions, national and regional business leagues, social clubs and government instrumentalities.

Mr. Simcoe also provides comprehensive tax guidance to businesses, including Subchapters C and S corporations, partnerships and sole proprietorships. He advises both domestic and foreign businesses on the U.S federal income taxation of international business operations.

In addition, Mr. Simcoe has represented taxpayers under audit by the Internal Revenue Service and the New York State Department of Taxation and Finance.

Education

Mr. Simcoe holds an LL.M. in Taxation from New York University Law School. He received a Juris Doctor, magna cum laude, from Albany Law School, where he was an Associate Editor of the Albany Law Review and a Dean Thomas Sponslor Teaching Fellow. He received a Bachelor of Arts, summa cum laude, in History from the University at Albany - SUNY.

Admissions and Affiliations

Mr. Simcoe is admitted to practice law in the State of New York. He is a member of the Albany County, New York State and American Bar Associations. He currently serves as a member of the board of directors of the Albany Collegiate Interfaith Center (Chapel House) at the University at Albany - SUNY.
